Warranty Policy
Every MONAK watch is prepared individually and subjected to functional testing and quality control before shipment. This policy explains the protection provided by our commercial warranty, the mandatory legal rights that may apply to your purchase, what is covered, and how to contact us if your watch requires assistance.
Every MONAK watch includes a 2-year international commercial warranty against covered manufacturing defects. Customers may also benefit from mandatory legal guarantees under applicable consumer law. In Portugal, new movable goods are generally covered by a 3-year legal guarantee of conformity.

MONAK stands behind the quality and performance of every watch we sell. Each piece is prepared individually after an order is placed and undergoes testing, inspection, and quality control before being approved for shipment.

This policy distinguishes between the voluntary commercial warranty provided by MONAK and the mandatory legal guarantee of conformity that may apply under consumer law.

The MONAK commercial warranty is additional to your statutory rights. It does not replace, restrict, suspend, or reduce any mandatory consumer protection available in your country.

1. MONAK 2-Year International Warranty

```

MONAK voluntarily provides a 2-year commercial warranty with every watch purchased directly from our website.

This commercial warranty begins on the date the watch is delivered and is available to customers worldwide, subject to the terms and exclusions described in this policy.

During the warranty period, MONAK will assess confirmed manufacturing defects and provide an appropriate remedy, which may include:

  • Repair of the affected watch
  • Replacement of a defective component
  • Replacement of the watch where repair is not reasonably possible
  • Another appropriate solution agreed with the customer
  • A refund where required by applicable law or where another remedy is not reasonably available

The remedy offered will depend on the nature of the issue, the result of the technical inspection, component availability, proportionality, and the rights available under applicable law.

2. Legal Guarantee of Conformity

```

In addition to the MONAK commercial warranty, consumers may benefit from a mandatory legal guarantee where a watch is defective, does not match its description, lacks an agreed characteristic, or is otherwise not in conformity with the purchase contract.

For purchases subject to Portuguese consumer law, new movable goods are generally covered by a 3-year legal guarantee of conformity from the date of delivery.

Consumers in other European Union countries benefit from the protection required by European Union law and any additional protection provided by the national law applicable to their purchase.

Customers outside the European Union may have separate statutory rights under the consumer laws of their country or region.

Mandatory legal rights apply independently of the MONAK commercial warranty and cannot be excluded by this policy.

3. What the Warranty Covers

```

Subject to inspection and the remaining terms of this policy, the warranty may cover manufacturing, production, or assembly defects affecting the proper operation or conformity of the watch.

Covered issues may include:

  • Failure of the automatic movement under normal use
  • A confirmed fault affecting winding or time-setting functions
  • A confirmed fault affecting the date function, where applicable
  • Hands that become detached, obstructed, or unable to move correctly because of a production defect
  • A crown or stem fault resulting from a manufacturing or assembly issue
  • Internal misalignment that materially affects the operation or appearance of the watch
  • A structural defect in the case, crystal, bracelet, clasp, or another included component
  • A product that materially differs from the description or agreed specifications
  • A fault resulting from how the watch was prepared before delivery

Coverage applies only where the issue is confirmed as a defect covered by this policy or as a lack of conformity under applicable law.

4. Automatic Movement Characteristics

```

Automatic watches are mechanical instruments. Unlike quartz watches, they may display a reasonable degree of daily timekeeping variation.

Accuracy and power reserve may be influenced by factors including wrist movement, wearing habits, resting position, temperature, magnetism, activity level, storage, and maintenance.

A reasonable variation in mechanical timekeeping does not, by itself, mean that the movement is defective.

A watch may also stop when it has not been worn or wound for a sufficient period. This is a normal characteristic of an automatic movement and does not necessarily indicate a fault.

If you believe your watch is operating outside reasonable mechanical tolerances, contact us so that its performance can be assessed.

5. What Is Not Covered

```

Unless applicable consumer law provides otherwise, the commercial warranty does not cover:

  • Normal wear and tear resulting from regular use
  • Scratches, dents, marks, fading, or changes to exterior finishing
  • Damage caused by impact, dropping, crushing, pressure, or accidents
  • Damage caused by misuse, negligence, or improper handling
  • Damage caused by unauthorized opening, modification, adjustment, servicing, or repair
  • Damage caused by use outside the stated water-resistance limits
  • Water damage caused by leaving the crown unsecured
  • Water damage caused by operating the crown or pushers while the watch is wet or submerged
  • Damage caused by hot water, steam, saunas, or sudden temperature changes
  • Damage caused by salt, chemicals, cosmetics, perfumes, cleaning products, or corrosive substances
  • Damage to straps caused by water, sweat, chemicals, friction, or ordinary deterioration
  • Loss, theft, or accidental damage occurring after delivery
  • Reasonable mechanical accuracy variation within normal operating tolerances
  • Reduced power reserve caused by insufficient winding or use
  • Magnetization caused by exposure to external magnetic fields
  • Issues caused by improper storage or insufficient maintenance
  • Cosmetic differences that fall within normal production or finishing tolerances

These exclusions do not apply where the reported condition legally constitutes a lack of conformity or where excluding coverage would restrict a mandatory consumer right.

6. Water Resistance

```

Water resistance is not a permanent condition and may decrease over time because of aging seals, impact, temperature changes, improper crown use, opening of the case, or ordinary wear.

Customers must follow the water-resistance rating and care instructions displayed on the relevant product page.

Unless the specific model is expressly described as suitable for such use, the watch should not be worn while swimming, diving, showering, bathing, or entering a sauna or steam room.

The crown must remain fully secured whenever the watch may be exposed to water.

The crown and any pushers must not be operated while the watch is wet or submerged.

Water damage caused by use outside the product's specifications or by failure to follow these instructions is not normally covered by the commercial warranty.

7. Bracelets, Straps, and Exterior Components

```

Bracelets, straps, clasps, crystals, coatings, and exterior finishes are covered where a confirmed manufacturing defect existed at delivery or becomes apparent during the applicable coverage period.

Ordinary cosmetic deterioration is not considered a manufacturing defect.

This includes:

  • Surface scratches caused by use
  • Marks caused by contact with desks, walls, clothing, or other objects
  • Natural leather deterioration
  • Stretching, creasing, staining, or discoloration of straps
  • Gradual wear of polished, brushed, plated, or coated surfaces
  • Damage caused by incorrectly resizing or adjusting a bracelet
  • Loss of removable bracelet links, screws, pins, or accessories

8. Maintenance and Servicing

```

Automatic watches contain mechanical components that may require periodic servicing to maintain reliable long-term performance.

Routine servicing, regulation, cleaning, lubrication, water-resistance testing, gasket replacement, and maintenance resulting from ordinary use are not included in the commercial warranty unless required to correct a covered defect.

The need for routine maintenance does not necessarily mean that the watch was defective at delivery.

Opening or repairing the watch through an unauthorized third party may affect commercial warranty coverage where that intervention caused or contributed to the reported issue.

This does not remove mandatory consumer rights relating to an unrelated original lack of conformity.

9. How to Make a Warranty Claim

```

If you believe your watch has a covered defect, contact us before sending the product anywhere.

To open a warranty request, please provide:

  • Your full name
  • Your order number or other proof of purchase
  • The email address used to place the order
  • A clear description of the issue
  • Clear photographs of the watch
  • A short video demonstrating the issue where relevant
  • Any timing observations or other information requested by our team

Warranty requests should be submitted to help@monak.com.

We aim to acknowledge and initially review requests within 3 business days. This initial review is not necessarily a final technical determination.

Some issues cannot be confirmed from photographs or videos and may require the watch to be physically inspected.

10. Return Authorization

```

Do not return a watch before receiving instructions from our customer-support team.

Once the request has been reviewed, we will provide the appropriate return procedure and return address.

Products sent to an unauthorized address, to the address displayed on the original parcel, or without sufficient identification may be delayed or returned to the sender.

Requiring prior communication helps us identify the product and process the claim correctly. It does not remove any mandatory legal right.

11. Warranty Inspection

```

A physical inspection may be required before warranty coverage or another legal remedy can be confirmed.

The inspection may include:

  • Verification of the product and order information
  • Visual inspection of the case, crystal, crown, dial, hands, bracelet, strap, and clasp
  • Testing of the automatic movement
  • Testing of winding, setting, date, and other applicable functions
  • Observation of timekeeping performance
  • Inspection for signs of impact, water exposure, magnetization, misuse, alteration, or third-party intervention
  • Assessment of whether the issue results from a covered defect, ordinary wear, accidental damage, or another cause

We will communicate the result after the necessary assessment has been completed.

12. Repair

```

Where repair is the appropriate remedy, MONAK may repair the original component, replace the affected component, regulate the movement, or carry out another action reasonably necessary to correct the covered issue.

Replacement components may have minor visual or technical differences where the original version is no longer available, provided that the repaired watch remains of equivalent quality and functionality.

Repair times depend on the nature of the issue, component availability, testing requirements, and shipping destination.

We will aim to complete covered repairs within a reasonable period and without significant inconvenience to the customer, as required by applicable law.

13. Replacement

```

Where replacement is the appropriate remedy, MONAK may replace the watch with the same model.

If the original model or configuration is no longer available, we will contact the customer to agree on a reasonably equivalent solution.

A replacement may be offered instead of repair where repair is impossible, disproportionate, unreliable, or not reasonably available.

The legal effect of a replacement on the remaining guarantee period will be determined by applicable consumer law.

14. Price Reduction or Refund

```

A price reduction or refund may be available where required by applicable law, including where:

  • Repair or replacement is impossible
  • Repair or replacement would be disproportionate
  • The issue has not been corrected within a reasonable period
  • The same lack of conformity reappears after an attempted remedy
  • The proposed remedy would cause significant inconvenience
  • The defect is sufficiently serious to justify another remedy

Where a refund is approved, it will ordinarily be issued to the original payment method.

The time required for the funds to appear in the customer's account may depend on the bank, card issuer, or payment provider.

15. Shipping Costs

```

Where a defect or lack of conformity is confirmed and covered under this policy or applicable consumer law, MONAK will cover the reasonable shipping costs required to provide the applicable remedy.

We may provide a prepaid shipping label or ask the customer to use a specific tracked shipping method.

Customers should not purchase an unusually expensive shipping service without prior authorization from MONAK.

If the inspection determines that the issue is not covered by the commercial warranty or mandatory consumer law, we will inform the customer before carrying out any paid repair or return shipment.

In that situation, the customer may be responsible for return-shipping or optional repair costs, provided that those costs were disclosed before proceeding.

16. Packaging Warranty Returns

```

Watches returned for inspection must be packaged securely to prevent damage during transportation.

The watch should not be shipped loose inside a box or envelope.

Customers should use sufficient protective material and follow any specific packaging instructions provided by our team.

Where possible, the customer should retain proof of shipment and the relevant tracking number until the claim has been completed.

17. Unauthorized Repairs and Modifications

```

Opening, modifying, engraving, regulating, servicing, or repairing a watch through an unauthorized third party may affect the commercial warranty where that intervention caused, contributed to, or prevents proper assessment of the reported issue.

MONAK may request information regarding previous repairs or modifications during the assessment.

An unrelated third-party intervention will not automatically remove a mandatory legal right where it did not cause or contribute to the lack of conformity.

18. Transferability

```

The MONAK commercial warranty is provided in connection with the original product and proof of purchase.

A subsequent owner may contact MONAK for assistance, but commercial warranty coverage may require the original order number, purchase information, and evidence of the original delivery date.

Mandatory rights available to a subsequent owner will depend on applicable law.

19. Watches Purchased from Third Parties

```

This commercial warranty applies to watches purchased directly from the official MONAK website or another sales channel expressly authorized by MONAK.

Watches purchased from an unauthorized reseller, marketplace seller, private individual, or other third party may not qualify for the MONAK commercial warranty.

In those circumstances, the purchaser may need to exercise their legal or contractual rights against the seller from whom the watch was purchased.

MONAK may still offer paid technical assistance where reasonably available.

20. Counterfeit, Altered, or Substituted Products

```

Warranty coverage does not apply to counterfeit products, watches falsely represented as MONAK products, products with altered identifying information, or products substituted for the watch originally purchased.

MONAK reserves the right to investigate suspected fraudulent warranty claims and to request appropriate purchase and identification information.

This provision will not be used to deny a legitimate claim without reasonable grounds.

21. Limitation of the Commercial Warranty

```

To the maximum extent permitted by law, the remedies available under the voluntary MONAK commercial warranty are limited to the repair, component replacement, watch replacement, or other remedy expressly described in this policy.

MONAK will not be responsible under the commercial warranty for indirect, incidental, special, or unforeseeable losses caused by the inability to use the watch.

Nothing in this policy excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any other liability that cannot legally be excluded.

Nothing in this policy restricts mandatory consumer rights or remedies.

22. Relationship with Other Policies

```

This Warranty Policy should be read together with our Terms of Service, Returns and Refund Policy, Shipping Policy, product descriptions, and care instructions.

A change-of-mind return is different from a warranty claim concerning a defective or non-conforming product.

Returns based on withdrawal or change of mind are governed by our Returns and Refund Policy.

Where another MONAK policy conflicts with a mandatory consumer right, the mandatory legal provision will prevail.

23. Changes to This Policy

```

MONAK may update this Warranty Policy to reflect changes to our products, procedures, commercial warranty, customer-support process, or legal obligations.

An updated policy will not retrospectively remove mandatory rights or commercial warranty coverage already attached to a completed purchase.

The policy applicable to a claim will be assessed according to the purchase date, delivery date, warranty provided with the product, and any mandatory legal provisions in force.
